Martin Mburu showed up at Peak Fitness of Knightdale for a lunchtime workout, but he found the doors locked and the gym equipment gone.
Gym members say they were given no notification that the facility would be closing. Many learned by reading the signs posted on the gym's window, notifying them that Planet Fitness of Knightdale has taken on their memberships.
"I didn't know this was going to happen," Mburu said. "I wish they'd told me this two months in advance, and I wouldn't have done this. I would have gone to a different gym."
A representative from Attorney General Roy Cooper's office said the Consumer Protection Division is investigating the closure and reviewing options.
A January 2009 settlement requires Peak Fitness to provide clients 90 days notice before closing or notice ‘immediately upon learning that a club will close or transfer.'
The agreement came about amidst financial problems in the company and other club closings.
In a statement, Laura Haid, vice president of operations at Peak Fitness' corporate office said, "During these tough economic times, Peak Fitness has had to make some sacrifices and very difficult decisions in order to sustain our operations. Through the consolidation of our underperforming clubs including, Knightdale Peak Fitness in Raleigh, we're optimistic we can get back on the right track and continue to serve our members."
People who entered into a renewed a membership contract within the past 90 days are eligible for a pro-rated refund if they choose to terminate their contract.
All Knightdale Peak Fitness' memberships will be honored at other Peak Fitness locations or at Planet Fitness of Knightdale.
Some people worry they will not have access to the same amenities they enjoyed at Peak Fitness, such as free child care and basketball courts.
"I want to have a choice," said membership holder Brad Carroll. "That's why I picked Peak in the first place."
